MINUTES OF THE DUXBURY SELECTBOARD October 8, 2007 Members present: JoAnn Berno, Kym Andrews, Dick Charland, Craig Isvak, Todd Liberty Others present: David Quenneville, Dan MacWalters, Stuart Ramsdell, David Specht, Martha Davis, Ralph Davis Town Insurance: Glenn Mink of Breen Insurance attended the meeting to present the Insurance Renewal Proposal to the selectboard. The cost is $20,642 and is down from last year’s cost. The board accepted and signed the proposal. Minutes and Bills: Bills were signed. JoAnn Berno made a motion to accept the September 10, 2007, minutes with two changes: 1) Include that the reason for the executive session was to discuss town legal matters. 2) Change the date of the next meeting to October 8, 2007. Todd Liberty seconded the motion, and all were in favor of it. Concerns Brought to Board’s Attention: A Duxbury citizen, who lives on Vigilante Road called JoAnn with concerns that there are many people who use that road to get to party places. They wanted to know what could legally be done to prevent people from going up there. The board and David Quenneville discussed this problem at length, and it was concluded that there is really nothing the town can do about it, and it is a police matter. Another matter brought to JoAnn’s attention by Phil Blake was his request that landowners be notified before decisions are made about ancient roads He lives out of state, and JoAnn told him that she would keep him informed. Townspeople to Address the Board: Marcia and Ralph Davis attended the meeting to express their concerns about the Leaf Peepers’ Marathon. They said they are concerned about safety issues, the road closing, and rude treatment by some of the runners. The board suggested that if she would get signatures from others who are also concerned, the race organizers would be contacted and invited to the November 12 meeting. Marcia said she would get a petition started. Questions/Issues for Town Clerk: Ken said he needs more frequent updates from the delinquent tax collector in the form of a monthly report. Jill Macarilla can contact Ken if she has questions. Also, she needs to deposit delinquent tax money as soon as possible to make interest on time. Regarding the reorganization of the town clerks’s office, Ken reported that the Browns’ River proposal did include lateral files. Craig Isvak would like another company, Business Interiors, to be allowed to submit a quote also. This will be done. The board encourages anyone who has concerns or comments about the renovations to attend the November 12 meeting Old Business: Several townspeople were present to discuss the ongoing issue of the water runoff on Morse Road that is presently causing problems for Dan MacWalters on his property. The issues discussed mainly included people’s reports of the history of the road as it relates to water runoff over the years The current problem seems to stem from a filled-in swale that used to be open. The questions are who filled it, whether or not anyone had a right to fill it, and the town’s right to open it again There is a question as to who filled in the swale and why and whether or not the state was involved in it. Besides this, however, there was discussion about issues such as curb cut permits, other development on the road above, crowned driveways, water bars, clear cutting, ditching, bank erosion, state involvement in the problem, and other matters that are contributing to a large water run-off problem on that road. The board needs time and advice as to how to proceed with this issue and no decisions were made. Research will continue and David Quenneville will call Ernie Englehardt from the state to take a look at the situation. Richardson Road work is at a standstill. There was a short discussion about how long the permit will last; with building permits, one has to build within a year. JoAnn will call around to find people to serve on the committee for ancient roads. Meanwhile, there is a grant application for money to work on ancient roads that is due on November 16. Kym will get started on the application. Road Report: Moretown is going to waive the fire service fee for Duxbury in return for allowing them to keep one of their trucks in the Duxbury Town Garage for the winter season as they did last year. They have sent a certificate of insurance. Todd Liberty made a motion to accept the agreement with Moretown while still including the $1800 in the Duxbury budget. Craig Isvak seconded the motion and all were in favor. The agreement was signed. Eric Ladensack is coming on duty on November 1, 2007. Regarding the grader, the board will seek one more proposal from another supplier before making a decision on this purchase. There was a short discussion on curb cut permit applications and follow-up on the terms of the agreements. Thoughts were that the DRB and David should be involved and that there should be one permit for access and a different one for underground. The meeting was adjourned at 9:05.
